Short-Term Rental Agreement and Additional Property Information

This Short-Term Rental Agreement (the “Agreement”) is entered into between Espiritu Operations LLC (Costa Rican entity 3-102-937507), represented by Benjamin Malcolm (hereinafter the “Owner”), and the Guest (hereinafter the “Renter”) agrees to the terms and conditions outlined within by making ‘agree to terms and conditions’ on booking request form. The property is located at Casa de Espíritu, Finca Los Pargos, Los Pargos, Guanacaste, Costa Rica.

 

1. Property Details

Property: Casita at Casa de EspĂ­ritu is a stand-alone casita located on a property with a main house occupied by the Owner. The property is 6300m2 or ~1.3 acres
Occupancy: Maximum of 2 adults (one must be over 21 years old) and up to 2 children (under 13 years old).
Casita Size: Approximately 55m²

  • 1 bedroom w/kind bed, workstation/desk, TV, Bluetooth speaker, and love sofa
  • 1 bathroom with overhead rain shower
  • Fully equipped kitchen with fridge/freezer/ice machine, range and oven, microwave, toaster, blender, pots/pans/dining ware, bar and dining area.
  • Amenities: Satellite Wi-Fi, parking, fans, air conditioning, hot and cold water, on-site parking and gate remote, pressurized and clean potable water with 5000L reserve (water outages very unlikely), 2 beach chairs and boogie boards
  • Power outages may occur; no discounts or refunds are offered if outages occur; the property is actively investing in solar panel infrastructure to prevent these from happening in the future. Outages are typically short although they can be prolonged during storms or when planned grid maintenance occurs.

 

2. Rental Term

  • Check-in time: 3:00 PM – 9:00 PM on the first day of the rental period.
  • Check-out time: 10:00 AM on the last day of the rental period.
  • Minimum stay: 3 nights. Maximum stay: 30 nights.
  • Early check-ins or late check-outs may be available upon request

 

3. Rates, Fees, Taxes and Payment, Cleaning, Laundry, and Meal Services

  • *Nightly Rate: $120 USD per night (min 3 nights, max 6 nights)
    *Weekly Rate: $700 per week (min 7 nights, max 28 nights – pro-rated at weekly rate for stays >7 days)
  • *Monthly Rate: $2650 (29-30 nights only)
  • *Holiday Rates (Dec 15-Jan 5 and April 1-20) are 25% additional. Low Season Rates (July 1-Nov 15) are 10% reduced.
  • Security Deposit: $250 USD up to 1 week; $500 USD from 8-30 nights (Refunded upon check out or post owner inspection)
  • Cleaning Fee: $25 for stays of 3–6 nights; included weekly cleaning and laundry service for 7+ nights.
  • Gate remote and key replacement fees: $50 for each gate remote or set of keys lost or damaged to the extent they are not functional
  • Meal Service and Onsite Dining: Opportunities for prepared meals and dining within your Casita or with the Owner may be available during your stay. A fee of $15 per person per meal will be assessed if you choose this option. Meal services are not guaranteed as part of accommodation and the property has limited abilities to adapt to specialized diets. Coffee, tea, rice, beans, and local fruits are included with your stay for your enjoyment within the Casita at no additional cost.
  • Payment Terms: Security deposit due at booking and refunded upon successful check out. Other payments may upon arrival or assessed as outlined in cancellation policy if cancelled <10 days before check in.
  • Payments may be made in USD or CRC equivalent via credit card, PayPal, or cash. Additional 13% tax payment required for credit card or PayPal payment.

 

4. Cancellation Policy

  • Full refund if canceled 10 or more days before check-in.
  • 50% refund if canceled 3–9 days before check-in.
  • No refund if canceled within 72 hours of check-in.

 

5. House Rules

  • No smoking or vaping tobacco products onsite or within casita ($500 extra fee if tobacco products used within casita)
  • No events or parties
  • No extra guests
  • No pets
  • Quiet hours 9:00 PM–7:00 AM
  • No entry to main house unless invited by Owner
  • No paper, hygiene products, or anything else that is not produced by the human body in toilets
  • No cryptocurrency mining, hydroponic growing, or other activities using excessive amounts of water or electric utilities

 

6. Liability and Waiver

Renter assumes full responsibility for accidents, injuries, or losses. Owner is held harmless from claims, damages, or expenses.

 

7. Privacy and Data

Security cameras may be in exterior areas. Personal data handled in compliance with Costa Rican Law No. 8968.

 

8. Mediation and Jurisdiction

Disputes go first to mediation in Guanacaste, then binding arbitration under Costa Rican law, and if unresolved, local courts in Santa Cruz.

 

9. Termination

Owner may terminate stays immediately for serious rule violations without refund. Renter may not sublease or assign agreement.

 

10. Entire Agreement

This is the entire agreement. Modifications must be written and signed by both parties. English version governs in conflicts.
